EUP is now Certificate of Compliance with new rules

We all understand the value of inspecting mechanical systems before use. This lets the DOB ensure occupants’ safety. These inspections and approvals led to an Equipment Use Permit, or an EUP. However, an EUP has now become a Certificate of Compliance. Check out these important updates.

What are the new rules I need to be aware of?

Previously, to obtain an EUP, you needed a qualified registered design professional (RDP). The RDP inspected and signed off on a building’s mechanical systems. (A DOB inspector could also complete the inspections). But that’s not the case with a Certificate of Compliance (COC). Along with the name change, new rules exist. Here’s a rundown of the major differences:

  • A new format is required for filing. Filing takes place through DOB NOW.

  • Registered design professionals and DOB inspectors no longer perform inspections.

  • Inspections must be performed by special inspectors who are affiliated with a Special Inspection Agency. The Special Inspection Agency needs an address in New York City. Or, at minimum, a registered agent with a New York address. (Learn more about Special Inspection Agencies.)

What is the process for a Certificate of Compliance for Equipment? Any advice?

As with any inspections, make sure you’re working with a special inspection agency with a good reputation. Check that they're up-to-date on all submission requirements and DOB rules. (Want a recommendation? Give us a call.) 

Your special inspector completes the inspection and submits a PW4 form in conjunction with an alteration application. A PW4 form lets you apply for a COC for Equipment. This form needs to be signed and sealed by your special inspection agency. Turn in a certified TR1 form as well.

Depending on the items submitted by the Special Inspection Agency, the DOB issues a Certificate of Compliance. Note: then the Special Inspection Agency’s needs to attach the Certificate of Compliance on or next to each piece of equipment. Failure to post the certificate means you’re out of compliance. This is true regardless of permitting. Anyone not in compliance can receive violations from the FDNY or the DOB.

FDNY approval

In some instances, your COC will require approval from the FDNY. Usually, this requires a permit account for the equipment you need inspected. However, there are cases where permit accounts are non-specific. The FDNY has different rules for inspections on a variety of equipment.

Once issued, your COC can be found in DOB NOW. Remember your COC needs to be placed on or next to the right equipment.
